“Can I please make a request under the Freedom of Information Act and I would like to request the following information about the organisation’s Local Area Network (LAN) environment. You may have received the same request in the past and this information sent has now expired and I require an update as soon as possible.

Please can you send me the organisation’s Local Area Network (LAN) contract, which may include the following:

• Support and Maintenance- e.g. switches, router, software etc

• Managed- If this includes services than just LAN.

1. Contract Type: Managed or Maintenance

2. Existing Supplier: Who is the current supplier?

3. Annual Spend for each supplier: What is the annual average spending on the supplier above? If there is more than one supplier, please split the annual averages spent for each supplier.

4. Number of Users: Please can you provide me with the number of users this contract covers. Approximate number of users will also be acceptable.

5. Number of Sites: The number of sites, where equipment is supported by each contract.

6. Hardware Brand: What is the hardware brand of the LAN equipment?

7. Contract Description: Please provide me with a brief description of the overall contract.

8. Contract Duration: What is the duration of the contract and can you please also include any extensions this may include.

9. Contract Expiry Date: When does the contract expire?

10. Contract Review Date: When will the organisation be planning to review the contract?

11. Responsible Officer: Contact details including name, job title, contact number and email address?

If the LAN maintenance is included in-house please include the following information:

1. Hardware Brand: What is the hardware brand of the LAN equipment?

2. Number of Users: Please can you provide me with the number of users this contract covers. Approximate number of users will also be acceptable.

3. Number of Sites: Estimated/Actual number of sites the LAN covers.

4. Responsible Officer: Who within the organisation is responsible for LAN please provide me with contact details including name, job title, contact number and email address?

If the contract is managed by a 3rd party e.g. Can you please provide me with

Our response

I confirm that Ordnance Survey does hold some of the information you have requested. Where the information is not held or exempt from disclosure this is stated. Taking each request in turn, I confirm the following:-

Part 1

1. Contract Type: Managed or Maintenance

3. Annual Spend for each supplier: What is the annual average spending on the supplier above? If there is more than one supplier please split the annual averages spend for each supplier.

£57,000 (excluding VAT). This figure relates only to the LAN aspect of the contract.

I confirm the job title for the persons responsible for the contract is the Procurement and Contract Manager.

The information relating to the contact name, contact number and direct email address is held by Ordnance Survey but is exempt from disclosure under section 40(2) (personal information) of the FOI Act, as the information constitutes personal data.

Section 40(2) provides that personal data is exempt information if one of the conditions set out in section 40(3) is satisfied. In our view, disclosure of this information would breach the data protection principles contained in the General Data Protection Regulations and Data Protection Act 2018.  In reaching this decision, we have particularly considered:

  • the reasonable expectations of the employees: given their positions, Ordnance Survey considered that none of the individuals would have a reasonable expectation that their personal data would be disclosed;
  • the consequences of disclosure; and
  • any legitimate public interest in disclosure.

Section 40(2) is an absolute exemption and therefore not subject to the public interest test.

However, under the duty to provide information and assistance in accordance with section 16 of FOIA, we can provide the following information which may assist you in this matter.

I confirm the day-to-day LAN maintenance is managed by the IS Service Delivery Manager for Ordnance Survey.

The information relating to the contact name, contact number and direct email address is held by Ordnance Survey but is exempt from disclosure under section 40(2) (personal information) of the FOI Act, as the information constitutes personal data, as detailed in our response to part 1, question 11.

Any other maintenance is managed by Computacenter (UK) Ltd under the Service Legal Agreement.

Part 3

If the contract is managed by a 3rd party e.g. Can you please provide me with:-

For this part of the request, we consider that you are referring to a third party as someone other than Ordnance Survey and Computacenter (UK) Ltd. We therefore confirm that the contract is not managed by a third party but by Computacenter (UK) Ltd and the day-to-day operations by Ordnance Survey.

We therefore do not consider this part of the request to be applicable to us. Please refer to the responses provided above.

Internal review

Your enquiry has been processed according to the Freedom of Information Act (FOIA) 2000. If you are unhappy with our response, you may request an internal review with our Internal Review Officer by contacting them, within two months of receipt of our final response to your Freedom of Information (FOI) request, as follows:

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.

Appeal to Information Commissioner’s Office (ICO)
If, following the outcome of the internal review you remain unhappy with our response, you may raise an appeal, within three months of receiving our response, with the Information Commissioner’s Office.
